Senate Bill 102, known as the Live Local Act, was signed into law by Governor DeSantis on March 29, 2023, and took effect on July 1, 2023. This legislation impacts certain local government regulations on zoning, density, and height for specific multi-family and mixed-use affordable housing projects. The act contains additional provisions that may impact development but may not be regulated by the Community Development Department. Each applicant must review the law and submit applications that comply fully with its terms.
Under the act, residential and mixed-use rental projects can receive administrative approval if the application satisfies each of the act’s requirements. Each application must still comply with all other requirements and restrictions outlined in Charlotte County’s Comprehensive Plan, the Land Development Code, the Code of Laws and Ordinances of Charlotte County, Florida and any applicable federal, state and county laws, rules and regulations.
